These Terms of Service (“Terms”) govern your access to and use of the Vigolium website, product, and related services. Please read them carefully.
1. Acceptance of Terms
By accessing or using the Vigolium website at vigolium.com, the Vigolium product, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Eligibility
You must be at least 16 years old and able to form a binding contract in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
3. Accounts and Access
Some parts of the Service may require an account. You are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly at security@vigolium.com if you suspect unauthorized access.
4. Acceptable Use
You agree not to: (a) use the Service to violate any law or third-party right; (b) attempt to gain unauthorized access to systems, networks, or accounts; (c) interfere with or disrupt the Service; (d) reverse engineer, decompile, or attempt to extract source code, except where permitted by law; (e) use the Service to send spam, malware, or harmful content; or (f) use the Service to scan, test, or target systems you do not own or have explicit written permission to assess.
5. Intellectual Property
The Service, including all software, text, graphics, logos, and documentation, is owned by Vigolium and its licensors and is protected by intellectual property laws. Open-source components are governed by their respective licenses. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these terms. All rights not expressly granted are reserved.
6. Customer Content
You retain ownership of any code, configuration, scan results, or other data you submit to or generate with the Service (“Customer Content”). You grant Vigolium a limited license to process Customer Content solely to operate, secure, and improve the Service. We will not sell Customer Content or use it to train third-party AI models without your permission.
7. Beta and Early-Access Features
Parts of the Service may be offered as beta, preview, or early-access features. These features are provided as-is, may change or be removed at any time, and are excluded from any service-level commitments.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. Vigolium does not warrant that scan results will identify every vulnerability or that findings will be free of errors. Security testing is inherently probabilistic.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIGOLIUM AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO VIGOLIUM IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
10. Indemnification
You agree to indemnify and hold harmless Vigolium and its officers, employees, and agents from any claim, demand, loss, or damages arising out of your use of the Service, your Customer Content, or your violation of these terms or applicable law.
11. Termination
We may suspend or terminate your access to the Service at any time without notice if you violate these terms or if we reasonably believe your use poses a security or legal risk. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes will be communicated through the Service or by email where appropriate. Continued use of the Service after the effective date of an update constitutes acceptance of the revised terms.
